Child Sex Offender receives Life Sentence without parole

Conroe, Texas – Timothy James Miller, age 33, was sentenced to the maximum sentence allowed under the law for a sex offender, Life without parole, by 435th District Court Judge Patty Maginnis for Continuous Sexual Abuse of a Child.

Miller’s trial began Monday, February 26, 2018. Continuous Sexual Abuse of a child alleges a defendant sexually abuses a child under the age of 14 for 2 or more times over a period that is 30 or more days in duration. The Punishment range for this offense is 25 years to Life in prison without the possibility of parole.

Prosecutors Adam McLane and Vincenzo Santini represented the State of Texas. The evidence showed Miller befriended a family with an eight year old daughter and hid the fact that he was registered sex offender. Miller gained the family’s trust to the point that they felt comfortable leaving their eight year old daughter alone with Miller.

On multiple occasions Miller forced the young girl to perform oral and anal sex with him. Miller threatened to kill the little girl’s siblings if she ever told. However, the victim courageously outcried to her mom when the mom brought up the fact that Miller would be best man at a wedding the family was planning. The mother immediately called 911 and the case was investigated by Detective Shannon Acosta who was with the Montgomery County Sheriff’s Office.

The young child was interviewed by a forensic interviewer with Montgomery County’s Children’s Advocacy Center, Children’s Safe Harbor and gave and even more detailed account of Miller’s abuse. Children’s Safe Harbor also provided a medical exam for the young child through specially trained nurses from Memorial Hermann.

On Wednesday, February 28, 2018 the jury found Miller Guilty of Continuous Sexual Abuse of the young child. The next day, Prosecutor McLane presented evidence that Miller committed these acts while being a registered sex offender for previously molesting a two year old child. Judge Maginnis also heard evidence that Miller video recorded him sexually assaulting the eight year old victim and these child pornography videos may still be online for other pedophiles to view. Judge Maginnis sentenced Miller to the maximum sentence permitted under the law for a sex offender. Life without parole is the equivalent to a capital punishment.

Prosecutor Adam McLane stated, “We admire the victim’s courage in this case. And we are excited that this sexual predator will never offend again in this or any community. He will die in prison as a punishment for the terrible things he has done.”
